1. Scope of terms

The following Terms and Conditions  ( in the following T&C ) govern the relationship between final customers and Sitetalk-Mall Ltd ( in the following Sitetalk Mall).The version of T&C at the moment of conclusion of contract will be the effective one.

2. Conclusion of Contract

The contract becomes effective with Sitetalk Mall’s confirmation of the order sent to the customer and/or the shipment of the products by Sitetalk Mall or its carrier to the customer.

3. Payment

Payment is due with remittance of the order to Sitetalk Mall. The customer will be default 30 days after delivery with the consequences of being responsible for interest and  indemnification.

4.Delivery of goods

The ordered products will be sent to the address of the customer indicated in the order. Shipping charges have to be paid by customer. The risk of loss and damage is carried by the customer beginning with hand-off to the shipper.
The delivered product has to be inspected by the customer immediately . Damages or losses reported to the Sitetalk Mall later than one week cannot be taken into account unless the damage was cognoscible under objective criterions only later. The damage report has to be sent in writing.
Sitetalk Mall is entitled to replace delivery by a similar product if the ordered one is out of stock. In this case the customer is entitled to reject the replaced goods and rescind the contract. In this case the expenses of reshipment have to be carried by Sitetalk Mall.

5. Title Retention

The delivered products remain in the ownership of the Sitetalk Mall until the customer has paid the requested price .

6. Warranty

In case of warranty the claims of customers are limited to subsequent supply. Only if this is not possible or it is unreasonable for Sitetalk Mall customers are entitled to demand for diminution or revocation.

7. Liability

Liability is excluded for other damages like human body or health in total even if the damage was caused by intention or gross negligence.

8. Applicable Law

This contract is ruled by the law of the country where the customer has his home address.

9. General Clause
If any provision in this T&C is or becomes inefficient the other provisions remain effective.
